Online Dispute Resolution (ODR)

The online dispute resolution platform (ODR) is provided by the European Commission to allow consumers and traders from the EU or from Norway, Iceland and Liechtenstein to resolve disputes related to products and services purchased online, without going to court.

The ODR platform is not associated with any trader. You can use it to bring your complaint before an authorized dispute resolution entity.

Dispute resolution entities are impartial organizations or persons who help consumers and traders reach an agreement through extrajudicial means. Usually, such a procedure is faster and cheaper than a judicial one.

The ODR platform is easy to use, guiding users step by step. It provides translations in all official EU languages and provides deadlines for complaint resolution.

Thanks to the ODR Platform, consumers can obtain fair solutions either for The online dispute resolution platform (ODR) provides consumers and traders with a way to resolve disputes related to purchases made online both from their own country and from abroad. Specifically, disputes are forwarded to alternative dispute resolution bodies (ADR entities) registered on the platform. These are selected by member states according to certain quality criteria and then communicated to the Commission.

More about the ODR platform can be found here: Remedies for EU consumers

Alternative Dispute Resolution (ADR)

What is ADR (Alternative Dispute Resolution)?

ADR represents an alternative mechanism to the judicial system, through which consumers are offered the possibility of resolving disputes they may have with traders, when they face a problem related to purchasing a product or service.

Thus, complaints against traders are presented voluntarily by consumers, to be resolved in an independent, impartial, transparent, fast and fair manner.

The Alternative Dispute Resolution Directorate has the competence to alternatively resolve national and cross-border disputes arising from sales contracts or service provision contracts concluded with a trader operating in Romania, in the sectors of activity in which ANPC is competent. The ADR notification form can be downloaded from the website of the National Authority for Consumer Protection (ANPC) or by clicking here: https://anpc.ro/documente/cerereSAL.docx

How is the Dispute Resolved?

In order to resolve the dispute, the ADR Directorate carries out the mechanism of proposing a solution to the parties, a mechanism according to which, if only one of the parties accepts the proposed solution, the result of the procedure is not mandatory. If the trader does not accept the proposed solution, the ADR Directorate informs the consumer, through decision, about the administrative, respectively judicial remedies to which they can resort for dispute resolution.

What are the Conditions for Accessing the ADR Procedure?

  • The dispute could not be resolved directly with the trader;
  • The complaint has not been previously analyzed by another ADR entity or by a court, nor submitted to another public authority;
  • The complaint is formulated within 1 year from the date it was presented to the trader or from the date of the act that gave rise to the dispute;
  • The handling of the dispute does not seriously affect the effective functioning of the ADR entity;
  • The dispute falls within the competence of the notified ADR entity.
